By purchasing, installing, using, or accepting any product or service from Bavarian Auto Parts, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.
1. Aftermarket Use – No OEM Affiliation
All products sold by Bavarian Auto Parts are aftermarket performance or replacement components unless explicitly stated otherwise. Bavarian Auto Parts is not affiliated with, endorsed by, or sponsored by any original equipment manufacturer (“OEM”).
Aftermarket automotive parts may:
- Alter vehicle performance, emissions, safety systems, or drivability
- Increase stress on drivetrain, engine, suspension, braking, and other systems
- Reduce component lifespan
Customer acknowledges and accepts these risks.
2. Off-Road / Competition Use Disclaimer
Unless explicitly stated otherwise in writing, all performance parts, tuning services, calibrations, and software are intended for off-road, racing, or competition use only.
Customer is solely responsible for ensuring compliance with:
- Federal, state, and local emissions laws
- Noise regulations
- Vehicle inspection requirements
- Roadworthiness and safety laws
Bavarian Auto Parts makes no representation that any product is legal for street use.
3. Professional Installation Recommended
Unless explicitly stated otherwise, all products are intended to be installed by qualified automotive professionals.
Bavarian Auto Parts is not responsible for:
- Improper installation
- Improper tuning or calibration
- Failure to follow instructions or industry best practices
- Damage caused by user error or third-party installers
Installation and use are performed entirely at Customer’s own risk.
4. Assumption of Risk
Customer understands and agrees that modifying a vehicle involves inherent risks, including but not limited to:
- Mechanical failure
- Engine or drivetrain damage
- Loss of vehicle control
- Property damage
- Personal injury or death
Customer voluntarily assumes all risks, known and unknown, associated with the purchase, installation, and use of any product or service provided by Bavarian Auto Parts.
5. Limitation of Liability
To the maximum extent permitted by law, Bavarian Auto Parts shall not be liable for any:
- Indirect, incidental, consequential, or punitive damages
- Loss of use, loss of profits, or loss of data
- Vehicle damage, engine failure, or component wear
- Personal injury or death
In no event shall Bavarian Auto Parts’ total liability exceed the amount paid by Customer for the specific product or service giving rise to the claim.
6. Indemnification
Customer agrees to defend, indemnify, and hold harmless Bavarian Auto Parts, its owners, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from:
- Installation or use of any product
- Violation of laws or regulations
- Misuse or modification of products
- Third-party claims related to Customer’s vehicle
7. Warranty Disclaimer
Except where prohibited by law, all products and services are provided “AS IS” and “AS AVAILABLE.”
Bavarian Auto Parts disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
Any manufacturer warranty is provided solely by the manufacturer, not by Bavarian Auto Parts.
8. Returns and Refunds
All returns and refunds are governed exclusively by the Bavarian Auto Parts Return Policy, which is incorporated by reference into these Terms.
9. Tuning, Software, and Digital Products
All tuning files, calibrations, and software:
- Are licensed, not sold
- Are non-transferable
- May not be copied, reverse engineered, or redistributed
Once delivered or accessed, digital products are non-refundable unless otherwise required by law.
10. Customer Representations
Customer represents and warrants that:
- The vehicle is mechanically sound prior to modification
- All information provided is accurate
- They have legal authority to modify the vehicle
11. Governing Law and Venue
These Terms shall be governed by and construed under the laws of the State of [Insert State], without regard to conflict-of-law principles.

12. Severability

By purchasing or using any product or service from Bavarian Auto Parts LLC, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
